Fantasy sports startup DraftKings has opted to vacate its new Noho office digs amid controversy, but its primary rival FanDuel is staying put.

A spokesperson for FanDuel said the company plans to move into its new 41,000-square-foot office at Rockrose Development’s 300 Park Avenue South later this month as scheduled. When asked if there are any plans to sublease all or part of that space, the spokesperson responded, in an email, “No, sir!”

Both fantasy sports companies are facing heat from New York State Attorney General Eric Schneiderman. They were ordered in November to cease operations in New York State by the AG’s office, which accuses them providing illegal gambling services.

FanDuel, valued at $1.3 billion, signed for the top three floors of the property in September, with asking rents of roughly $80 per square foot. A representative for Rockrose declined to comment.

Meanwhile, DraftKings will sublease its new 23,500-square-foot space at Alvin Flaster’s 400 Lafayette Street, as previously reported. A spokesperson for that company denied that the decision is tied to its legal troubles.
