Last year, developer Sheldon Solow sued Conseco Inc., claiming that it fraudulently sold 767 Fifth Avenue, the General Motors building, to developer Harry Macklowe. Now Solow’s lawyers have issued a subpoena that would require Macklowe’s lenders, Fortress Investment Group and Deutsche Bank, to reveal documents concerning their $1.2 billion in loans to Macklowe, who used 767 Fifth Avenue as collateral.
