The Board of Standards and Appeals this morning approved the
construction of 360 Smith Street, also called the Oliver House. It will go forward
according to the old zoning rules, which allow the building to be 70 feet tall
rather than 55 feet. The Department of Buildings testified that the foundation
was only 20 percent finished when the Carroll Gardens Zoning Text Amendment was
passed in July, but the board ruled that the foundation was “substantially
complete,” and construction could continue according to the old law.
