  • Cassidy Turley New York has filed suit against developer Dan Shavolian
    alleging he failed to pay a $2.3 million commission on a February 2010
    lease agreement with the Bowery Residents Committee.

    The brokerage, which previously operated under the name Colliers ABR,
    alleged in the July 14 suit that Shavolian, working through a firm called 127
    West 25th, breached an agreement by failing to pay the commissions at 127
    West 25th Street, which were due in several installments starting in October
    2010.

    The suit is the latest in a long running series of disputes at the building, as
    community groups and local politicians have protested and gone to court to
    stop BRC from putting a homeless shelter in the building. … [more]

    A New York Supreme Court judge rejected an injunction request submitted by opponents of the forthcoming Bowery Residence Committee homeless shelter to prevent it from opening Friday. DNAinfo reported that the judge did not find the shelter’s large expected occupancy (it will have 200 beds) in violation of local law, and said the building, at 127 West 25th Street, can open for occupancy starting Friday. The injunction was submitted by the Chelsea Flatiron Coalition, one of several groups opposing the homeless shelter, to prevent the building from opening before a hearing with the Department of Homeless Services July 22.     City Council Speaker Christine Quinn is attempting to block the July opening of a 328-bed homeless shelter in Chelsea, according to DNAinfo. The 12-story facility at 127 West 25th Street was built primarily to house 200 New Yorkers with a history of mental illness, while also providing space for a reception center and for victims of substance abuse. But Quinn penned letters to Mayor Michael Bloomberg and the New York State Commisioner of Temporary and Disability Assistance, Elizabeth Berlin, saying the shelter, named the Bowery Residents Committee, does not comply with local zoning laws. … [more]

    A controversial proposed Chelsea homeless shelter is forging ahead, despite heavy opposition from neighborhood advocacy groups, according to DNAinfo. The shelter, which would house upward of 328 individuals at 127 West 25th Street between Sixth and Seventh avenues, hasn’t yet received its city contract, but the Bowery Residents Committee, which is developing the facility, said it plans to move forward. The proposed shelter, which has garnered modest support from Community Board 4, has faced vociferous opposition from neighborhood group Chelsea Flatiron Coalition, which says the facility is too large and would pose safety issues for residents. … [more]

    The Bowery Residents Committee, together with the Department of Homeless Services, is moving forward with plans to convert an old factory into a homeless shelter
    for 328 drug addicts and mentally-ill men at 127 West 25th Street. But the project, which would include extensive medical services alongside the shelter, is not permitted by local zoning
    at the Chelsea building, where the BRC signed a 33-year lease and is making $12 million in renovations, the Post reported. Now, the Chelsea Business and Property Owners Association is suing the BRC for trying to “circumvent” local zoning laws that bar such a project, while ignoring city regulations limiting shelters to no more than 200 beds. “This is a classic case of the ends justify the means,” said Dan Connolly, a lawyer for the Chelsea association. Muzzy Rosenblatt, the former Homeless Services commissioner who runs the RBC, believes that the lawsuit is without merit. “The suit will be dismissed and the project will proceed,” he said. [Post]

The $12 million construction project, which is expected to be complete in February 2011, faced widespread community scrutiny throughout its planning stages. Now, it’s facing a formal complaint from a coalition of local property and business owners who say they’re concerned that the BRC is not proceeding with proper zoning and construction regulations. “We will work with the community and city agencies to get people to examine the improprieties and irregularities in this process,” said Daniel Connolly, the attorney representing the complainant. “And absent the owners stopping work on this project, we have no choice but to file.” The building, which is already underway, is set to open at 127 West 25th Street.   • A controversial bid to open a homeless shelter in a manufacturing zone
    at 127 West 25th Street in Chelsea won initial city approval based on
    plans which hid key medical services that would violate zoning
    regulations, the New York Post reported. In its application to the
    Department of Buildings, the Bowery Residents Committee omitted nursing
    stations, exam rooms and doctors’ offices from the plans. But in a
    funding application filed with the state’s Department of Alcoholism and
    Substance Abuse, the group’s architect included plans that were
    significantly different and included the full range of medical
    services. “In light of public statements and filings with other city
    and state agencies, the department is reviewing the proposal to
    determine if the project fully complies with the applicable laws and
    regulations,” said Department of Buildings spokesperson Jennifer
    Gilbert. BRC signed a 33-year lease for the building and committed to
    roughly $12 million in renovations before it signed a contract with the
    city’s Department of Homeless Services. BRC’s lawyers cited Donald
    Trump’s luxury hotel at 246 Spring Street also in a manufacturing zone,
    as a precedent for the project, which has drawn ire from local
    residents. Asked about the conflicting plans filed to the city and
    state, BRC’s director, Muzzy Rosenblatt, a former city Homeless
    Services Commissioner, told the Post that the “the project is complying
