Corcoran ruling upheld in appellate court

A ruling against the Corcoran Group was upheld yesterday, in a landmark case that found agents -- and not firms -- to be in ownership of their own client lists, Crain's reported. Three years ago, the New York state Supreme Court ruled in favor of ex-Corcoran Group agent Sarit Shmueli, who claimed that her former employer, and executive vice president Tresa Hall, in particular, had stolen her client list "deliberately and maliciously" off of her computer after she had been fired. Shmueli was awarded $400,000 in compensation and $1.2 million in punitive damages. The brokerage's appeal, which began proceedings last month, didn't go completely unrewarded, however. The appellate court ruled to vacate the punitive damage award for Shmueli, on the grounds that the "defendant's practice of precluding a terminated employee from having access to its computer system does not evince a high degree of moral turpitude," according to court filings. Shmueli said that she will pursue an appeal of the ruling in order to regain her punitive damage award. [Crain's]

#2 ummm the Appellate court ruled the opposite of that. Sarit, nice post in number 4. Not allowing terminated employees access to computer systems is standard practice in just about all comanies/industries. Her atttoreny will probably take a healthy chunk of the 400K maybe as much as a third if he/she was on a contingency arrangement and since damages were for compensation, what will the tax impact be ? Could be a significant tax impact. Since there is always the chance that the appealling the appellate court decison could wind up reducing the compensatory portion of the award, her lawyer will probably advise her to settle.

Speaking objectively as an insider, Sarit was a high-ranking Corcoran broker, not only in terms of volume and income, but also she was highly regarded amongst her peers. Many of us were sorry to see her go. She was well liked around here, and Corcoran management wouldn't tell us why Sarit was fired, and of course for legal reasons Sarit was advised not to speak with anyone here after she left. As a broker and colleague, she was fair, reasonable & hard-working, and in every way an asset to Corcoran. Her departure was mysterious, to say the least - and left many of us wondering when we might be next. Sad to say, these court rulings will be a wake up call for many of us here at the Corcoran Group.

Crains New York reported: Ms. Shmueli said she plans to appeal the appellate division ruling on the grounds that the jury in the original case found Corcoran liable for punitive damages because her termination from the brokerage and the withholding of her client lists was “retribution for her refusal to suborn perjury.” Ms. Shmueli claims she was terminated for refusing to give false testimony in a civil case against Corcoran after her manager, Ms. Hall, demanded that she do so.

Nice try #12. Noone could stand the sight of her at the office. Many agents would get up and leave when Sarit showed up to work. Her long stories about how everyone in the world was trying to screw her drove everyone nuts. She was always saying that the agents were out to get her. I remember one incident where she said her shoes were stolen and she had to walk home barefoot and that her fur coat had been in the closet and someone had spray painted it white. Now we know who did all of that and her name was Sarit. When she was at Corcoran, she would throw on the fake tears when needed and make everyone feel sorry for her. We were all on to her. Tresa Hall should win an award for firing her.

What a wonderful story to wake up to. I can't believe this woman is still out there lying her head off. Oh my god. I used to sit behind her group at Corcoran. She needs to avoided at all costs. Sarit now shame on you. Tresa Hall is one of the best assets at Corcoran and we all love and respect her. If you think that you can defame her here, well you have another thing coming. She is the most ethical manager in the industry and one of the most liked. I can't imagine a judge would believe you.

I was hired by Tresa Hall when I was new to the industry. My initial impressions of her at my interview turned out to be correct: a person of limited intelligence, with no particular knowledge of real estate, and a total yes-person to the higher-ups. The managers she hired to work under her had even less smarts than she did, and so the nightmare ensued -- when we needed help, there was no one to go to. The diaspora of Corcoran agents to other companies over the last 20 years is the result Barbara Corcoran's short-sightedness in hiring such a management team.

Corcoran hung onto Sarit Shmueli for 12 years, lining their pockets with the business she brought in for them. So Shame on Corcoran for trying to defame her now, particularly since the judgement against Corcoran was upheld by unanimous decision of the Appellate court. Is Corcoran trying to suggest that Sarit duped 5 Appellate judges? Do they really think the public doesn't understand the legal system? This is a STUNNING defeat for Corcoran - there is nothing more humiliating than to receive a 5-0 decision against you in the Appellate Court. I heard that Corcoran tried to settle with Sarit -- which would have averted the 2 court judgements and a permanent record against them. (A defendant only offers such a settlement when their hands are dirty - it's a convenient way to make it all just go away). Sarit refused, preferring to take Corcoran all the way to the finish line -- and to justice. Thus these court rulings, which will benefit ALL real estate brokers, so we owe a debt to Sarit's courage and tenacity.

#17: #15 here- No thin air, I used to work at Corcoran until earlier this year and know many of my co-workers that got tired and left as well. I know many others that are still there and have been in doubt for a long time but scared to leave. I think this incident will be very eye opening to them.

#28: Yeah, I was also scared to leave Corcoran. I had never worked anywhere else, and they had me brainwashed into believing that Corcoran was the only game in town. But having attended some REBNY events, I took the opportunity to approach the heads of 2 firms (both of whom chaired key REBNY committees). I was honest with them per my concerns about Corcoran, and they were equally honest with me. They didn't "trash" Corcoran -- they just gave me permission to acknowledge that what I was observing was NOT a mirage -- Things REALLY were as bad as I saw them to be. I finally left Corcoran 6 years ago, and in retrospect I can't believe I worked for such a disgusting bunch of folks.

How did Ms. Corcoran do well? Her lenders sold the company out from under her when her debt soared past $30M (hey, putting her face on every billboard in town got expensive). And because it was a short-sale, Barbara had to cough-up $3M to seal the deal. Corcoran’s President PAM LIEBMAN cheated the judge and the jury: she was on Corcoran’s witness list, and was sitting in the courtroom, hiding behind the taller people in the audience / courtroom, and she was learning the testimony of the witnesses, prior to her testimony! LIEBMAN VIOLATED THE COURT’S RULES by cheating the judge and the jury! When the judge found out, he asked Liebman to leave the courtroom and after discussing it with the jury he had to follow the court’s rules and he did not allow her to testify in the actual trial. Liebman only testified in the one day trial for the Punitive Damages amount, in which she bagged the Jury not to award Punitive damages against Corcoran because “it will affect the BONUSES” for her and her managers… (See Court Transcripts pages 499-500, 541-543)

#42 - I like this comment: If you were to familiarize yourself with the American court system, you'd know that it's designed so that "Liars" don't get very far, and neither do mud-slingers. So instead of shooting from the hip (in true Corcoran style) why don't you just read the court record online, and learn the truth of this case? And, while Shmueli has unnecessarily gone overboard in contributing to this blog, she need not justify herself because the system has already spoken in her favor - and not out of sympathy, but only after reviewing reams of evidence and the vote of an impartial jury. The American justice system works - it's the system under which we all choose to live, and in following due process of law, justice always speaks through in the end.

During the trial, Corcoran NRT and Cendant had EIGHT (8) attorneys in the courtroom. Liebman probably was sitting in the courtroom for several days... and listened to the other 3 witnesses of Plaintiff who testified prior to Sarit’s testimony.

Bottom Line

No, I'm someone who backs up all my client data in multiple locations and doesn't act like an idiot to get myself fired. This whole case was about distinguishing the difference between what a company owns- the computer, and what an independent contractor put into it without backing it up elsewhere. Sarit was stupid enough to do it and lucky enough that the courts to sorted it out to rule in her favor. End of story.

Corcoran /Pam Liebman offered the Real Deal extra advertising (money), if the Real Deal will help Corcoran to trace the Corcoran’s agents who revealed the names of Sandy Shaw - Jeff Peckage - Reah Stein - Ann Snee, in their comments posted here. However, if the Real Deal will do it, they will never be in business again!

We heard that in August 2008 Sarit was one of the leading witnesses for the NY ATTORNEY GENERAL Andrew Cuomo’s office, in the Security bonds fraud case against 20 banks. The lawyers at the attorney Generals office loved Sarit as a leading witness, “Sarit is a naturally honest witness, which any Jury and judge appreciate”.

We the brokers at Corcoran know the fact that at the trial of this case, Corcoran’s witness TERENCE THOMAS, originally from the island of Jamaica, lied under oath for Corcoran. In exchanged, one week before the trial, Thomas became the Director of Information Technology! Obviously, the jury did not believe Tomas‘s fabrications and cover ups, but, hey he got promotion for lying under oath in court, for Corcoran. Terence Tomas got promotion for lying in court for Corcoran, which it will hurt him professionally for the rest of his life. Thomas’s name is under the “Investigation’s List”. This will go further.

This important message is for Sarit: We over heard in Pam Liebman’s office that one of Corcoran’s attorneys, Bragar Wexler Eagel & Squire is an old time friend of the Chief Clerk of the Appellate Division Court, John W. McConnell !!! McConnell’s signature appears on ALL the decisions of the Appellate Court. Corcoran’s attorneys never got sanctions by the Appellate Court, for their violations and misconducts, because of John W. McConnell. The Appellate Division is NOT good for your case !!!

Sarit, we have read the court files: 1) Corcoran’s attorneys were never sanctioned by the Appellate Division Court, for their violations and misconducts in this case. 2) The Appellate Division Court ignored the Corcoran 10-12 misconducts in this case, these 10-12 misconducts purely called for Punitive Damages award against Corcoran. Are John McConnell and other authorities PROTECTING CORCORAN AND THEIR ATTORNEYS? If any attorney in this city would have done what Corcoran’s attorneys did in this case, he/she would’ve been sanctioned three (3) times by the Appellate Court.

#181 and 182 I understand what you saying. Thank you! I believe that Corcoran and their attorneys could not control the Appellate Division Court. At the Oral Argument on November 17, 2009, Corcoran’s attorney lied when he said “Corcoran is a large company and the management did not know that Ms. Shmueli had client list on the computer...” We can’t blame the Appellate Division judges for Corcoran’s attorneys’ actions who mislead and lied to them at the Oral Argument! We must believe in the Court system… We will fight it! Million Thanks.

We just found out that Sarit is not going to appeal the decision of the Appellate judges of December 8, 2009! The decision of the appellate judges was unanimous! A unanimous decision could not be appealed!

#191: NOT TRUE. The Appellate Court can be petitioned to re-consider their decisions, and they can accept -- or deny -- such a petition.

It is clear that the appellate court understood & supported the Corcoran theft-conviction. However, it's equally clear that they did not fully understand the damages award to Shmueli. While it is rare for a 5-0 decision to be reconsidered, it's not unheard of, and a compelling arguement to reconsider is indeed warrented here.

This ruling begs the question of how far reaching this decision is. Does it apply to commercial real estate brokers as well? What about other professional sales persons e.g. mortgage brokers, stock brokers, and financial planners? What if a salesperson signed a non-compete clause in their contract when they were hired, are the leads still the property of the broker?

Tresa Hall is one of the most upstanding honest human beings I have ever met. I was diagnosed with cancer two weeks after I started at Corcoran.and if it hadn't been for Tresa and her support I don't know how I would have survived. It's a great pity that people have jumped on the band wagon to insult this extraordinary woman.

As an independent contracted producer formerly with an overly aggressive large insurance carrier that uses ie signge and hands in their logo, I'm very interested in how this court verdict will affect the rights of professional independent contractors across the landscape, in clarification of their property rights. I am a director with one of the large insurance agency associations, so I have a particular interest on this Corcoran court.
