Shmueli appeals in Corcoran client list case

Aiming to send a message to the real estate industry, former Corcoran Group agent Sarit Shmueli has filed to appeal a recent court ruling stripping her of punitive damages a jury awarded her after she claimed the company stole her electronic client list.
Three years ago, the New York State Supreme Court found in favor of Shmueli, who had sued the company alleging that Corcoran, and in particular, executive vice president Tresa Hall, had stolen her client list "deliberately and maliciously" from her computer after Shmueli was fired. Shmueli was awarded $400,000 in compensation and $1.2 million in punitive damages.
Corcoran appealed the decision, and the Appellate Division in December 2009 upheld the compensatory damages ruling, but decided to vacate the punitive damage award on the grounds that "precluding a terminated employee from having access to its computer system does not evince a high degree of moral turpitude," according to court documents.
On Jan. 6, Shmueli filed a request for the case to be heard by a higher court, the New York Court of Appeals. In the request, Shmueli's attorney, Herald Price Fahringer, argued that the Appellate Division made a mistake when it referred to her as an "employee" of the Corcoran Group. Rather, like most city real estate agents, Shmueli was an independent contractor, he said.
This "misapprehension was absolutely critical to the outcome of the case because there are vast differences between the rights of employees and independent contractors," Fahringer argued in court documents. "The law is clear that customer information -- such as client lists -- stored on a computer leased and utilized by an independent contractor remains the personal property of the independent contractor -- not the computer's owner."
Moreover, the denial of access to the computer was "only one of many acts involving moral turpitude inflicted upon Sarit Shmueli by Corcoran," Fahringer's request said.
Shmueli was an agent at Corcoran from 1996 to 2002. In 2002, her suit claimed that Corcoran asked her to "falsely testify" in response to a lawsuit alleging that the company had failed to disclose material information to the purchaser of the apartment. When Shmueli refused, she claimed, she was fired, and prevented from returning to the computer where her client list was stored.
"Corcoran unconscionably and flagrantly retaliated against Shmueli because of her refusal to commit perjury for Corcoran in a separate civil lawsuit," Fahringer argued in court documents.
Corcoran has since claimed that Shmueli was fired because she swore in the office.
Fahringer told The Real Deal that the case has far-reaching consequences for the real estate industry, and that Corcoran should be publicly punished for its conduct.
"The whole purpose of punitive damages is to warn the public that we won't tolerate this," he said. "This is an important case to stress to realtors that you can't behave in this way, and if you do, you're going to be punished."
Corcoran said it could not comment on pending litigation, and its attorney, Lawrence Eagel of Brager Wexler Eagel & Squire, did not respond to phone calls from The Real Deal.
Fahringer said he's asked real estate organizations to file "amicus briefs," stating that they have an interest in the outcome of the case, in support of his request that it be heard by the New York Court of the Appeals.
The closely-watched case has also attracted attention because Hall, Shmueli's former manager, won a lifetime achievement award in October from the Real Estate Board of New York for "outstanding achievement in the residential real estate market, but has also displayed outstanding ethical conduct in the profession."
After the December ruling, Shmueli and others in the industry called for Hall to be stripped of her award.
Hall "should absolutely return the award, because she was found guilty," Shmueli told The Real Deal by phone.
Hall was not immediately available for comment.
But Real Estate Board of New York President Steven Spinola said the organization is not considering such a move.
"Her peers gave [Hall] the award for a lifetime commitment to our industry," he said. He added that the outcry surrounding the case "can't take away the respect and love she has earned along with that lifetime achievement award."
Shmueli said she believes Corcoran has "a monopoly" in REBNY decisions because its parent company, NRT, also operates a number of other New York real estate firms, including Sotheby's International Realty.
Hall's award likely won't have much impact on the facts of the case, Fahringer said, but it does demonstrate that Corcoran has considerable influence in the industry.
"What I think is under the surface of this case is that these large organizations feel they can do whatever they want to do," Fahringer said. "They forget they have to abide by the law as everyone else does. They're so accustomed to having things their own way that they can sometimes form some very bad habits."
Shmueli said she now has her own real estate company, called Sarit, Inc. But she said it's been difficult to rebuild her business.
"I'm not as active as I used to be," she said. "I don't have my clients -- Corcoran has my clients."

So vital are client lists to a broker, this underscores how critically important these lists are to brokers, as well as the recurring nature of this issue. It is imperative that proper actions be taken against the Corcoran Group and that Ms, Sarit receive the proper compensation due her as a result of the lifetime recpient awardee Ms. Hall. As a long term broker in the industry we rely on the respect and trust of our elected officials, and legal system to properly emply the nature of our indepedent contractor status and our intellectual property. Furthermore REBNY who is commonly a lobbyist for us is suddenly finding itself in an administration that really does not cow down to lobbyist, hence they are in the awkward position of collecting millions of dollars of our yearly dues yet they cannot properly advocate on our behalf. For that matter neither can Ms. Hall. This is a very visible situation and we independent contractors are monitoring this from all firms to see that Corcoran and REBNY do not violate us any further. Go get em Sarit!

How cowardly of Steve Spinola to pass the blame onto the real estate community for selecting Tresa Hall for REBNY's lifetime achievement award. Those of us in the room that night when Hall was announced the "winner" heard the audible gasps of disbelief from the attendees, and the many comments of some highly respected REBNY officers - One of whom (a previous recipient) was heard to say "How could they give it to that idiot?"

NRT-Realogy the parent company of Corcoran, monopolized NYS and REBNY, they own the Corcoran Group, City Habitats, Sotheby’s, Coldwell Banker, Century 21, ERA and many other sub companies. Now, the real estate prices - “Price Fixing”- and the REBNY -“voting system”- are in great jeopardy. The interests of NRT, Realogy, Corcoran, will always take precedent in NYS. As a result of this Monopoly: Tresa Hall who was found liable in this case by the NY Supreme Court Jury that concluded “Tresa Hall and Corcoran deliberately and maliciously stole the valuable client lists of Shmueli”, but in October 2009 Hall was elected by REBNY for “Life time achievement award for ethical work”. The NY real estate brokers clearly demanded that Tresa Hall must return the award to REBNY, as she was found guilty by the NY Supreme Court Jury.

The credibility of the Corcoran Group has been in steady decline for a long time, due to to main factors: (1) The room-temperature IQ's of it's "leadership" team, and (2) the brain-drain caused by the hundreds of top brokers who fled Corcoran for other firms. The exodus of Herve Senequier, Leonard Steinberg, Lisa Lippman, Irene Lowenkron, Shlomi Reuveni, and countless others attests to Corcoran's tarnished image.

As President Nixon said, “When the President does it that means it is not illegal”. Corcoran adapted same view: If Corcoran does it, then it's not illegal. However, the six jurors unanimously recognized that big companies, such as Corcoran, are not above the law. The jury unanimously found that Corcoran and its executive Tresa Hall’s course of conduct evinces a high degree of moral turpitude.

Tresa Hall's prior employment positions (airline stewardess & bar tender) were the arenas where she honed her performance "skills" as she demonstrated in her "professional capacity" at Corcoran. Ifsomeone had too much drink, she threw them out -- so she figured "same thing if a broker misbehaves - just throw them out, and find some better-behaved drunk to take their place." Clearly this woman has no ability or skills to guide the careers of talented real estate brokers. The real blame for this mess belongs with Barbara Corcoran (a total sucker for flattery - Tresa used to fawn all over her...) and to Pam Liebman, who should have fired Tresa years ago for her incompetence. BUT, Pam's just as vulnerable to flattery, and is most comfortable surrounding herself with less intelligent people who won't threaten her in any way.

#20 Case law is already established IN FAVOR OF THE INVIDIUAL BROKER/AGENT - stating that - client/customer lists belong to the INDIVIDUAL BROKER/AGENT NOT BROKERAGE. This appeal filed by Sarit is for the Court of Appeals to overturn the decision once in her favor to be awarded the punitive damages of $1.2M (which was overturned when Corcoran appealed). Sarit is fighting for her punitive damages of $1.2M as originally awarded and should WIN!

#21- the case law will not mean anything if the companies would not be punished for their actions, by punitive damages. The Punitive Damages award would stop the companies from malicious actions, stealing client lists. Further, without punitive damages companies like Corcoran will continue to demand their brokers to suborn perjury for them, if the brokers will refuse to commit perjury, the company will RETALIATE, terminate the brokers and steal their client lists. Punitive Damages award is the KEY to stop Corcoran and other companies from stealing client lists, in the future. Yes, this involved 56, 581 brokers and 58,400 salespersons across the New York State.

Corcoran’s executive Tresa Hall demanded that Ms. Shmueli suborn perjury for Corcoran in an unrelated case, the “Coffaros” case. Ms. Shmueli refused to suborn perjury for Corcoran, and in retaliation Corcoran terminated Shmueli and stole her (1400) client lists. Ms. Shmueli was called into Corcoran’s management office and summarily terminated; while Ms. Shmueli was being detained in the management’s offices, Corcoran’s personnel entered Ms. Shmueli’s office and changed her computer codes so that only they could access its information.

Not true. If this happens again, and another agent commences a law suit, this case will be used in support of any facts that are similar and Corcoran and/or any other company that decides to steal or withhold client lists that may be on their computer or files will have tto release them to that agent. Punitive damages would be beneficial to make them PAY for their misdeeds, THIS WAY THEY THINK TWICE BEFORE SHUTTING DOWN THE AGENT FROM ACESS TO THEIR LISTS.

#27 obviously that would be the defense, since brokers/agents are NOT EMPLOYEES they are INDEPENDENT CONTRACTORS. I would assume same applies all electronic information, not only the client lists stored on the company computer hard drive, e-mails also, which are stored on the company's server, or any mail that is received by the company addressed to the agent. That all should be released and/or forwarded to the broker/agent. LESSON: new agents or seasoned agents - KEEP ALL YOUR FILES/INFORMATION ON YOUR OWN LAPTOPS. CONTROL ALL YOUR E-MAILS AND KEEP A SEPARATE E-MAIL (PERSONAL) AND ALSO USE YOUR OWN PERSONAL PHONE NUMBER. OTHERWISE, THE COMPANY WILL SCREW YOU IF YOU EVER GET RETALIATED AGAINST AND TERMINATED. BROKERAGES ARE NOT FAIR IN THEIR PRACTICES, AS PROOF BY THIS LANDMARK CASE.

In giving Tresa Hall their lifetime achievement award, REBNY has been caught red-handed in a pay-for-play scandal -- which is the lowest behavior any such organization could display. Offering real estate firms the REBNY shield of credibility in exchange for dues, (plus "awards" for supposedly maintaining their "ethics") simply means that REBNY "credibility" can be purchased. Speaking objectively as an insider, Sarit was a high-ranking Corcoran broker, not only in terms of volume and income, but also she was highly regarded amongst her peers. Many of us were sorry to see her go. She was well liked around here, and Corcoran management wouldn't tell us why Sarit was fired. As a broker and colleague, she was fair, reasonable & hard-working, and in every way an asset to Corcoran. Her departure was mysterious, to say the least - and left many of us wondering when we might be next. Sad to say, these court rulings will be a wake up call for many of us here at the Corcoran Group.

Suborning perjury is a crime! Corcoran’s executive Tresa Hall demanded that Ms. Shmueli suborn perjury for Corcoran in an unrelated case, the “Coffaros” case. Ms. Shmueli refused to suborn perjury for Corcoran, and in retaliation Corcoran terminated Shmueli and stole her (1400) client lists. Ms. Shmueli was called into Corcoran’s management office and summarily terminated; while Ms. Shmueli was being detained in the management’s offices, Corcoran’s personnel entered Ms. Shmueli’s office and changed her computer codes so that only they could access its information.

Pam Liebman is still in deep shock. NEVER did she dream Corcoran would lose this case. She led her NRT bosses down the garden path, and they trusted her that Corcoran would prevail. As a loyal Corcoran broker for 15 years, I'm sure I speak for many of my colleagues who feel betrayed by Corcoran managements' behavior as exposed in Sarit's case. Liebman violated the court rules by cheating the judge and the jury! Corcoran’s Management: If you were to familiarize yourself with the American court system, you'd know that it's designed so that "Liars" don't get very far, and neither do mud-slingers. So instead of shooting from the hip (in true Corcoran style) why don't you just read the court record online, and learn the truth of this case? The system has already spoken in Sarit’s favor - only after reviewing reams of evidence and the vote of an impartial six Supreme Court Jurors and impartial five Appellate Court judges. The American justice system works - it's the system under which we all choose to live, and in following due process of law, justice always speak through in the end.

Why does anyone care about a client 'list' anyway? A good agent is protected by the relationships they create with their clients. Isn't the information on a client 'list' property of both the agent and broker? Isn't the client going to follow where the relationship is? In some cases the firm but in most cases with the agent they have been dealing with on an ongoing basis personally? Thus the client ultimately decides? Why does a court need to decide?

Chapter 11 was Barbara's only option once her debt went over the $30M mark. But NO WAY were her lenders about to let her do that! The March 17th, 1997 issue of New York Magazine quoted super- broker Robby Brown, who called his client Arnold Scaasi "a garmento, a jew, and gay". Robby was an Elliman broker at that time, but the publicity caused Barbara Corcoran & Esther Kaplan to chase after Robby & hire him for Corcoran! (Twice, actually - because he quit Corcoran the first time around after only a few months...). BUT, Corcoran fired Sarit Shmueli for saying "bull s..." in the office! Indeed, Hall testified that she terminated Ms. Shmueli because brokers told her that Ms. Shmueli used the word “B.S” in the office. Hall also testified that she “NEVER heard Ms. Shmueli use any foul language or act unprofessionally”. Corcoran’s malicious act terminating Ms. Shmueli and stealing her client lists was premeditated, in retaliation for her refusal to commit PERJURY for Corcoran.

In the past, REBNY's lifetime achievement award went to some truly distinguished individuals, all of whom earned & deserved it (Peter Marra, Diane Ramirez, Betsy Dean, John Wollberg, etc.). That REBNY's awards committee could have even considered giving this same award to Tresa Hall begs the question "What were they smoking?"

Give credit to Sarit Shmueli for not only winning a jury verdict and Appellate Court decision, but also winning a Landmark Decision against the largest real estate agency in New York City, the Corcoran Group, who was represented by top attorneys. Sarit represented herself.

Sarit Shmueli is one of many ex-Corcoran brokers to have suffered such indignities from Corcoran's inept & thuggish manager-ladies (yes, sadly 95% of them were female). No abuse was off limits to them - everything from bullying, yelling, threats, intimidation, kick-backs - they were shameless. Finally it's all coming to a boil, and it's about time. Thanks, Sarit, for having the guts to haul Corcoran into Supreme Court for some long overdue justice - which many others were just too beaten down to do.

Prior to Corcoran, Tresa Hall was an airline stewardess. So, having appointed an army of light-weights to key management positions (all of whom later plotted her ouster), Barbara Corcoran shaped the disastrous course of The Corcoran Group. Finally, they are now all suffering the ripple-effects of Barbara's pathetic character judgements & shoddy decisions. They were all hired for the same reason - Barbara thought they were no threat to her, but in hindsight she truly underestimated Pam Liebman.

Corcoran is truly "Living who they are" -- a wild pack of bullies & bandits, out to hoodwink whomever they can. What they sent around truly came around, and the reality is far more than they can handle. This mega exposure of their abuses is well deserved and long overdue. The problem with REBNY however, is that they have their own agenda, and therefore will more than likely not go the route of the agents. Why did Tresa Hall object to Sarit saying "bull s--t"? Corcoran West Side manager Elaine Dean says bull s--t all the time, and also she frequently refers to people as "A-holes". This foul-mouthed manager has driven a slew of agents to other companies - many of them are superstars who left a huge dent in Corcoran's bottom line.

THE FACTS: Ester Kaplan was Sarits' benefactor and gave her 70% of her business. After her exit from Corcoran Sarit's business was non-existent. She had no client lists to steal. The catalyst for her meltdown was the result of a lawsuit by one of her customer's for material misrepresentation. After her termination a dozen brokers who sat near her hired a healer to smudge her desk. NRT in their arrogance is resposible for losing this scam artist case.

Here's the lesson: When you are wrong, humbly admit it and when necessary, pay the price. But most importantly, learn from the mistake and don't make it again. Additional Press Release: CHAPTER 11 was Barbara's only option once her debt went over the $30M mark. But NO WAY were her lenders about to let her do that! SO, they quietly shopped the Corcoran Group to interested buyers, NRT offered them $27M, so Barb's lenders took that money and then chased her down for the remaining $3M. Taking Pam up on her offer to cover the short-fall was the dumbest thing Barbara could have done, and it cost her the very position that she so desperately CLUNG to.

350, 351: Corcoran unconscionably and flagrantly retaliated against Shmueli because of her refusal to commit perjury for Corcoran in a separate civil lawsuit. Stealing the client lists was only one of multiple criminal activities by Corcoran involving moral turpitude inflicted upon Shmueli by Corcoran.

#353: Barbara's lenders really had her over a barrel. If she dared to protest their short-sale of her company to NRT, all they had to do was make one phone call to the press, & Barbara would have been permanently ruined. So she quickly came up with what she thought was a face-saving plan - getting of rid of Esther, appointing Pam (as long as she covered her debt), etc. And for a while it worked, but now the truth comes tumbling out...

#357 - Sad ending for Barbara Corcoran and Esther Kaplan! When Esther Kaplan left, she took her honesty with her… then the top brokers Sarit Shmueli, Harve Senequire, Leonard Steinberg and others client list were stolen by Corcoran’s management. Seneqiure and Steinberg did not have a choice but to break into Corcoran’s office in the middle of the night to retrieve their client lists from Corcoran’s computer. Shmueli sued Corcoran’s management to get her client lists back… Now the damage is being felt - BIG TIME, Corcoran will never be the same. Corcoran sunk and they took REBNY with them!

Hey Mr. Spinola - New York Supreme courts have now convicted the Corcoran Group of Racial Steering, Theft, Suppression of evidence, and bullying their brokers to Perjure themselves. And your REBNY "Lifetime Achievement Award" winner has been branded a thief by the high courts. If you had any integrity, you would yank Tresa Hall's award away for Lifetime Achievement, to set an example that this behavior cannot be tolerated.

How cowardly of Steve Spinola to pass the blame onto the real estate community for selecting Tresa Hall for REBNY's lifetime achievement award. Those of us in the room that night when Hall was announced the "winner" heard the audible gasps of disbelief from the attendees, and the many comments of some highly respected REBNY officers - One of whom (a previous recipient) was heard to say "How could they give it to that idiot?"
