Judge tosses suits over Upper East Side waste transfer site

Residents accused Army Corps of Engineers of ignoring environmental impact

A Manhattan federal judge dismissed two lawsuits attempting to halt the construction of the divisive marine waste transfer station project at East 91st Street yesterday.

Upper East Side residents and local leaders alleged in the suits that the U.S. Army Corps of Engineers ignored the environmental consequences of the project despite issuing the city a permit for construction. Judge Paul Crotty ruled that the issuing of the permit was “rational and well-supported.”

The plaintiffs filed the suits back in 2012, the New York Daily News reported. That year, the project received federal approval, as previously reported.

Opponents argued that there could be potentially damaging health effects, especially since the ramp leading to the facility lies next to the Asphalt Green ball fields. [NYDN]Mark Maurer
