Appeals court rules against group opposed to Pierhouse hotel
Judge upheld 2015 decision on lawsuit
Views of the Brooklyn Bridge from the Brooklyn Heights Promenade won’t be improving anytime soon.
The New York State Court of Appeals ruled against the community group Save the View Now on Wednesday, which had filed a lawsuit arguing that the hotel component of the Pierhouse development in Brooklyn Bridge Park is 30 feet higher than its 100-foot limit, partially blocking views of the Brooklyn Bridge, according to the Brooklyn Eagle.
State Supreme Court Justice Lawrence Knipel ruled in 2015 that the group had filed its lawsuit past the four-month statute of limitations, and the Appeals Court upheld this decision.
The four-judge panel said Save the View Now was right about the park not submitting proof of approval dates for its rooftop structures that exceeded the height limit but agreed with Knipel’s ruling that members could have figured out the building was taller than the limit sooner than they did.
