Lawsuit filed over Boynton’s Holiday Inn Express approval

Three Palm Beach Leisureville residents filed a Palm Beach Circuit Court lawsuit over the site plan approval for the Holiday Inn Express development near their homes.

Carol Beach, Carmelann Powell and Sandra Peterson-Hardt want a judge to overturn the Boynton Beach City Commission’s October 2013 vote in favor of the plan for the hotel at 2001 West Ocean Drive. They claim the proposal for West Ocean Drive to be used as the hotel’s primary entrance and exit violates city zoning law.

The proposed four-story, 93-room Holiday Inn Express has been fiercely opposed by certain Leisureville residents for several years, according to the Palm Beach Post.

“There is no need or necessity to utilize West Ocean Drive, Ralf Brookes, the attorney representing the residents, wrote in a court filing. “West Ocean Drive is classified as a local road that is used by residential district and should not be used as ingress or egress to the C3 hotel and is contrary to the purpose and intent of the zoning district.”
