The Fourth District Court of Appeal knocked down a proposal to build an eight-story hotel next to a 23-story condominium along the downtown waterfront in West Palm Beach. Developer Leisure Resorts, LLC, proposed building a 107-room hotel called Palm Harbor Marina on a commercial site just south of the Waterview Towers condominium.

The appellate court agreed with legal counsel for owners at the Waterview that enforceable property restrictions limit building height at the proposed hotel site to four stories. In response to the appellate court ruling, a city spokeswoman for West Palm Beach said the municipal government plans to pursue “all legal remedies” remaining. [Palm Beach Post] Mike Seemuth
