Empire State Realty Trust is a real estate investment trust and the owner of the Empire State Building. The trust officially went public in 2013 when real estate syndicator Malkin Holdings spun off the initial public offering for the skyscraper. The IPO included about a dozen other office buildings and several retail properties in both New York City and nearby counties in New York State and Connecticut. The IPO proved to be somewhat contentious, as both Malkin and Empire State Realty Trust were caught up in a number of lawsuits, including one class-action by investors who claimed the new real estate trust unfairly compensated them (most of those have settled in Malkins favor). In the years since, the occupancy in the portfolio (and the Empire State Building) has dropped off, but Empire State Realty Trust has been able to offset those losses with occupancy increases in the retail portion of the portfolio.
