Court strikes down Mitchell-Lama law

A New York State Supreme Court judge struck down Local Law 79, which was adopted by the City Council in August 2005. The law allowed tenants in Mitchell-Lama rental buildings constructed after 1973 to buy their buildings if the properties’ Mitchell-Lama term restrictions had expired. The Real Estate Board of New York filed a lawsuit against the City Council’s adoption of the statute, and the Department of Housing Preservation and Development and the Department of Housing and Urban Development–which oversee the city’s Mitchell-Lama properties–had not been enforcing Local Law 79 while it was the subject of litigation. more By Gabby Warshawer
