Judge dismisses Atlantic Yards suit

The Federal District Court in Brooklyn dismissed a lawsuit brought by opponents of the Atlantic Yards project. The suit challenged the proposed use of eminent domain to seize homes and businesses in order to make way for Forest City Ratner’s stadium-housing-office complex in Prospect Heights. The judge did, however, reject a prior court recommendation that the lawsuit belonged in state rather than federal court, and the plaintiffs intend to appeal the ruling in federal court. TRD
