A resident of 737 Park Avenue is facing accusations that she ran an illegal bed and breakfast out of her rent-controlled duplex in the white-glove building, according to court papers spotted by the New York Daily News.
The building’s landlord, 737 Park Avenue Acquisition, filed papers in New York State Supreme Court, alleging that Elizabeth Murray has rented “portions of the apartment to transient, short-term occupants for a fee, thereby operating a bed and breakfast from the apartment.”
The landlord is attempting to evict Murray — whose father moved into the unit back in 1969 — for the violation of her lease.
As The Real Deal previously reported, another lawsuit involving a rent-stabilized apartment was decided in December. The property’s landlord had accused Brown Harris Stevens broker Carol Cohen, formerly of the Corcoran Group, of lying about her income on state forms in order to prevent a rent increase at her rent-stabilized apartment. The New York State Supreme Court Appellate Division ultimately ruled that there was no evidence to substantiate the landlord’s accusation.
The building is currently being converted into condos by Macklowe Properties and has faced yet another $14 million lawsuit from a prominent Upper East Side plastic surgeon. [NYDN] —Christopher Cameron
