Citi Bike wins second suit over bike rack placement

With another victory in the courtroom, Citi Bike rides onward. A Manhattan judge dismissed a lawsuit today from the 20-story Cambridge House co-op that alleged a 39-bicycle kiosk in a parking lane broke the city Department of Transportation’s rules.

The Cambridge House’s lawyer, Steven Shore, had argued that the rack placed outside the West Village apartment building should have been installed on the quieter south side of West 13th Street as planned on an initial DOT map, as previously reported. The rules, cited by the court, bar the racks from being located in parking lanes that double as driving lanes at various times during the day.

“If this laneWas A Driving Lane during certain times of the day, the sign would have had the wording ‘No Standing’ instead of ‘No Parking,” Judge Cynthia Kern said, as reported by the New York Post.

Last week, the judge also ruled in favor of Citi Bike regarding Soho’s Petrosino Square park, which holds a 32-bicycle rack. She said it could stay because it served a recreational function. Two other Citi Bike suits are pending. [NYP] — Mark Maurer
