Judges tosses “Rent is too damn high” lawsuit

Outspoken ex-candidate will be booted from his St. Mark’s Place apartment in one week

Preach as he might, the Rent Is Too Damn High party leader Jimmy McMillan took a hit today when a Brooklyn federal judge dismissed his lawsuit seeking to halt his eviction from a rent-stabilized East Village apartment.

McMillan, a former gubernatorial candidate, claimed his landlord Lisco Holdings was illegally trying to evict him by falsely claiming that he was using his $872 per month rent-stabilized apartment as a second home. McMillan holds that he lives there and uses a second apartment in Brooklyn as an office.

“I’m done… I got one week left and my options are limited,” McMillan told the New York Daily News. “I’m going to start packing up my computers and my suits this weekend. I got money to pay rent but I’m not going to find anything lower than the rent on this place.”

While the judge expressed sympathy, he said there was no basis for McMillan’s claims of extortion, and also said that McMillan failed to allege discrimination though he mentioned that he suffers from PTSD.

McMillan still has a lawyer attempting to get a stay of the eviction order in the state appellate court, but if that fails, he will be evicted on Feb. 5. [NYDN] — Tess Hofmann
