The Third District Court of Appeal overturned the dismissal of a lawsuit filed by a condo association against a hotel and spa operator in Coconut Grove.

A three-judge panel determined the Grove Isle Association’s 2009 suit was improperly dismissed by a Miami-Dade Circuit Court judge, Daily Business Review reported. The association represents condo owners on the private Fair Isle, which includes the Grove Isle Hotel & Spa. It claims unit owners were unfairly assessed for common area maintenance including the bridge between the hotel and residential areas.

The assessments date back to 1979, according to the suit. But the Third District judges said the statute of limitation prevents any issues before 2004 from being part of the case. [Daily Business Review]Eric Kalis
