State and local lawyers urged Florida Chief Circuit Judge Charles
Francis to dismiss a lawsuit challenging a new amendment that allows
homeowners to continue to receive property tax breaks when they move.
Three out-of-state arrivals contend that Amendment 1, which voters
approved in January, violates their right to travel. The state
constitutional amendment amplified differences between their taxes
compared to longtime Florida residents, who pay much less for homes of
the same value. Government lawyers have cited a 1992 Supreme Court
ruling on a similar conflict concerning California’s Proposition 13,
which defended tax breaks for long-time residents.
