The family of Robert Durst’s missing first wife, Kathleen McCormack, asked a Nassau County Supreme Court judge to seize the real estate scion’s assets as part of a $100 million wrongful death lawsuit.

McCormack’s mother, Ann, and three sisters filed suit against Durst last month in connection to her 1982 disappearance, which was highly publicized in the HBO documentary miniseries “The Jinx” earlier this year.

Durst is currently being held in a New Orleans jail on gun charges and is awaiting extradition to California for the 2000 death of friend Susan Berman, according to the New York Post.

But the McCormacks worry that Durst may try to transfer his reported $100 million net worth to his second wife, real estate broker Debrah Lee Charatan, who has power of attorney over her husband and his finances.

The family’s suit clams that Durst murdered Kathleen and hid the body – violating “sepulcher,” a New York law providing family members the right to a proper burial for a dead relative. [NYP]Rey Mashayekhi
