The listing for a phony $85 million penthouse at the Atelier is no more.

The unit at 635 West 42nd Street had been on the market since 2013 but was just a huge bait-and-switch scheme, and owner Dan Neiditch has pulled it from the market, according to the New York Post.

The penthouse was being advertised on the 45th and 44th floors but was actually comprised of 12 apartments that were occupied. The listing was on StreetEasy as a way to draw viewers to less impressive units at the building and make it seem more impressive to potential buyers, the Post reported.

The Atelier also got caught up in an Airbnb scandal last fall, when the Mayor’s Office of Special Enforcement raided the building and doled out 33 violations for illegal short-term rentals. Neiditch’s brokerage River 2 River received over $700,000 in payments from a travel company that rented out Atelier units on Airbnb and other lodging websites, the Wall Street Journal reported last week.

But just because this listing has been taken down doesn’t mean Neiditch is done playing games. Another unit at the building is still listed for $50 million and described as spanning 12,500 square feet with 18 rooms. But declaration plans for the condo building shows that the unit actually spans just 1,070 square feet. [NYP] – Eddie Small
