NYU hails key legal victory in expansion lawsuit

New York University scored an important legal victory last week in its push to expand almost 1.9 million square feet, the Local East Village reported. The New York Supreme Court rejected a request for discovery brought by a coalition of groups including the Greenwich Village Society for Historic Preservation, the East Village Community Coalition, and NYU Faculty Against the Sexton Plan.

At a Feb. 26 hearing, the coalition had argued that the City Planning Commission and City Council– which both approved the university’s expansion plans – should be ordered to produce documents regarding the approval.

The university said it was “very pleased with the judge’s ruling, particularly coming as it does less than three weeks after a ruling in our favor in the other suit filed against the plan,” according to a press release seen by the Local East Village.

The coalition has alleged in a September 2012 lawsuit that the city violated a law preventing the transfer of parkland without prior approval from the state legislature. The judge is likely to hear oral arguments on the case by mid-May, according to the law firm representing the coalition, the Local East Village said. [Local East Village]  –Hiten Samtani
