Chelsea condo board to ground-floor gym: Lose the weights!

Residents have sued over alleged noise from dropped dumbbells

Residents of a Chelsea building have gone to court to, er, exercise their rights — and force patrons of a gym on the first floor to stop slamming their dumbbells on the ground and causing a racket. The condominium board at 257 West 17th Street has sued downstairs neighbor Brick New York in an attempt to curb the fitness center’s ways.

The high-end gym, which opened in August and has members repeatedly drop free weights and medicine balls as part of training sessions, allegedly makes so much noise residents wake up at 5:45 a.m. every day, DNAinfo reported. The hubbub continues until after 8:00 p.m., which residents say keeps them from being able to go “about their daily routines in the manner a person might reasonably expect,” the lawsuit said.

Despite a specially designed floor, the sounds are not muffled and bother residents who live as high as five floors above the gym, the suit claims.

Both the gym and the condo board brought in acoustics firms to test the noise levels, and both concluded the racket to be above the legal limit, the suit says.

The lawsuit ultimately hopes to get Brick to abandon its weight-dropping ways. A spokesman for the gym declined to comment to DNAinfo. [DNAinfo]Julie Strickland
