Attorneys warned on foreclosure ruling

Greenberg Traurig issued an alert to its lawyers this week following the ruling by the 4th District Court of Appeal in favor of homeowners. According to the alert, the court’s ruling, which called an affidavit of indebtedness inadmissible hearsay, the ruling could “dramatically change the foreclosure landscape in Florida.” The ruling overturned a judgment by the Palm Beach County Circuit Court that Gary and Anita Glarum had owed their bank $422,677. “This decision could have broad sweeping application in the lending and loan servicing industries and effect [sic] thousands of foreclosure cases, among other types of cases,” the alert said.
