David Miller, 36, is facing three charges: felony robbery by sudden snatching, felony criminal mischief and a misdemeanor domestic violence battery charge. He entered a plea of not guilty, and his arraignment is scheduled for later this month. 

Miller is a real estate agent with Berkshire Hathaway HomeServices EWM Realty, and he previously worked at Lennar. He did not immediately respond to requests for comment. 

It marks at least the second alleged domestic violence episode for Miller. Last year, Miller was arrested on a felony charge of domestic violence battery by strangulation and a misdemeanor charge of domestic violence by another victim. 

The latest charges were brought by an ex-girlfriend, who told Miami Beach Police officers that after a verbal dispute at Miller’s father’s house at 6 Star Island Drive, Miller wouldn’t let her leave, according to a copy of the incident report, obtained by The Real Deal.

She tried to get into the driver’s seat of his car, but he pulled her out and forcefully touched her, ordering her to go inside the guest house. Once inside, Miller “pushed her and placed his hand around her neck,” telling her “I thought you liked this,” according to the police report. 

She repeatedly told him to stop, but Miller continued to touch her and bit her lip and tongue; she “managed to get away and began making her way to the main house, looking for Mr. Miller’s dad to no avail,” the report states, noting injuries to her lower lip.

When she tried to get an Uber to escape, Miller allegedly grabbed her iPhone and smashed it. A maintenance worker noticed what was happening, which is when Miller ordered her a rideshare from his phone, according to the report. The robbery and mischief charges are related to her phone. 

That evening she went to the police department in person to report the alleged assault. She also submitted multiple videos from past incidents that depict Miller “in fits of rage” and that backed up the woman’s testimony regarding a history of alleged abusive behavior, according to the police report. 

Miller surrendered and was taken into custody on March 25. 

Miller has been a licensed agent with Coral Gables-based BHHS EWM Realty since at least 2016. The brokerage “does not have any comment” on the charges, according to a spokesperson. 

In 2020, Miller was the agent on the $49.5 million sale of his father’s spec mansion at 22 Star Island Drive. 

David Miller lives at 350 Meridian Avenue in Miami Beach. His penthouse is on the market for $8.5 million with a Douglas Elliman agent. Property records show he paid about $5.6 million for the 3,000-square-foot, three-bedroom unit in 2015. 

Miller’s grandfather, Leonard Miller, co-founded Lennar with his business partner Arnold Rosen in 1954. Miller is one of Stuart Miller’s four adult children. Stuart Miller, executive chairman and co-CEO of Lennar, is worth about $1.1 billion, according to Forbes.
