Sale pits Sotheby’s v. Aby Rosen

Final bids for the Aby Rosen-owned Upper East Side building that houses Sotheby’s are due today, but it may not be the smoothest of transactions for Rosen. The auction house says it intends to pursue Rosen for violating the terms of its lease, which could add up to $200 million if the building goes for the $500 million Rosen is asking. Although neither side would comment about the dispute on the record, at issue is whether Rosen should have offered to sell the building to Sotheby’s for $300 million two years ago in a “right of first offer.” Sotheby’s originally sold the building to Rosen for $175 million in 2002. more [NYT]
