School construction stalled due to “disconnect”

City lawyers say a “disconnect” between the state environmental review process and cleanup regulations led to confusion about whether it was legal for the School Construction Authority to approve the Mott Haven Schools Complex, at East 153rd Street and Concourse Village West. Acting State Supreme Court Justice Patricia Anne Williams ruled last month that the School Construction Authority violated state law by approving the Mott Haven Schools Complex without putting forward a plan to monitor toxins at the site. But city lawyers said the city followed a different state cleanup law, which allows the monitoring plans to be submitted later. The $230 million campus on 6.6 acres will be shared by two high schools, in addition to one high school/intermediate school and a charter school for fifth through eighth graders.
