Residents of two luxury buildings in Lower Manhattan, who were displaced by Hurricane Sandy, are lawyering-up and seeking damages. Residents of 88 Greenwich Street filed a $35 million suit against the condo board and property manager, alleging that building management took no precautions against flooding, Law360 reported. The tower was declared uninhabitable.
Also, residents of 2 Gold Street — who already released an open letter claiming negligence in their building — are suing the developer, owner and manager of their building, TF Cornerstone.
Plaintiffs Michael Cashwell and David Barker brought the 2 Gold case to state court in Manhattan yesterday, also accusing owners of the adjacent building, 201 Pearl Street, of negligence running up to the storm.
Tenants, who were told they cannot move back until March, are seeking “damages and other appropriate relief for their claims arising out of defendants’ negligence relating to their failure to adequately secure the premises subsequent to the multiple warnings issued…and for their negligence relating to their failure to mitigate damages following the storm,” according to the case’s legal documents, cited by Curbed.
