After settling a $10 million lawsuit from an angry condominium board last month, Denny’s is proceeding with plans for its first restaurant in the city, having recently applied for a full liquor license.

The condo board of a landmarked 24-story building at 150 Nassau Street filed suit in June to block a Denny’s from operating at the site’s commercial space, as The Real Deal reported. The case was subsequently “discontinued with prejudice,” meaning that the board cannot a file another suit that makes the same claims.

In May, amid opposition from residents, Denny’s had withdrawn an application for a beer and wine license from Community Board 1.

“We’ve been engaged in discussions with the condo board at 150 Nassau St. and continue to maintain an open dialogue regarding development,” a Denny’s spokesperson said in a statement provided to DNAinfo. “The board is aware that we are pursuing a liquor license at this time.”

Jamaica, N.Y.-based real estate fund the Babaev Group owns the commercial space, which was occupied by Taco Bell before the building underwent a conversion in 2003. Denny’s signed a lease there early last year. [DNAinfo]Mark Maurer
