A condominium board on the Upper West Side is anything but 420-friendly. The board at 400 Central Park West is suing one of its residents, claiming the excessive marijuana smoking is infiltrating the building.
Board members claim the residents of a first-floor studio apartment, Unit 1S, owned by Josefina Henriquez-Berman, are smoking so much that the odor is making its way throughout the 19-story, 414-unit building and upsetting residents.
“Sometimes it feels like you’re coming off the elevators and walking into a scene out of a Cheech & Chong movie,” the woman, who declined to give her name, told the New York Post.
Since 2011, Henriquez-Berman and her son Charlie Berman were fined 20 times for marijuana smoke and loud noises, according to court documents.
Residents are allowed to smoke in their units, but are supposed to confine the smells to Their Place, the Post reported.
The board is looking for the residents to stop smoking or install proper air filtration, and is suing for $10,000 in addition to $12,000 in unpaid common charges, the newspaper reported.
A one-bedroom at 400 Central Park West goes for around $1.5 million.
Last year, Henriquez-Berman allegedly tried to combine her unit, which she owns, with the adjoining apartment, that she rents for stabilized rate of $1,183 a month, according to the Post. She was sued and a judge ordered her to stop the work. [NYP] — Dusica Sue Malesevic
