Lawyer places another lien on 1 Prospect Park West

Move could further delay Haysha Deitsch’s planned sale to Sugar Hill

Just weeks after a judge ordered 1 Prospect Park West owner Haysha Deitsch to pay $3.4 million to wronged residents, a lawyer for another set of former tenants has placed a third lien on the property.

The lawyer, John O’Hara, represents the seven residents who died at the nursing facility at the building, whose estates are suing Deitsch for wrongful death.

The $5 million lien, filed in May, is the third on the property, the other two also being for $5 million, the New York Daily News reported.

The liens must be paid before Deitsch can complete the long-delayed sale of the 130-room facility to Sugar Hill Capital for $76.5 million.

The landlord bought the property in 2006 for $40 million. He signed the sales contract with Sugar Hill in 2014, and then allegedly harassed the buildings aged residents in order to move them out and accelerate the sale.

Seven tenants held out. Five of those are still living. Deitsch was ordered to pay $3.4 million to that group earlier this month. They’re required to leave by August 31st. [NYDN] Ariel Stulberg
