Town Residential has agreed to withdraw its request for a temporary injunction to stop Wendy Maitland from working at Brown Harris Stevens.
Instead Town and Maitland, the brokerage’s former president of sales, came to an agreement that she would not attempt to solicit any agents from Town pending a trial, and would inform the company if she plans to do business with any of its customers or clients.
Per the agreement, the two parties cannot discuss the terms of the deal with the media, public documents show. A judge denied Town’s previous request for a restraining order.
Both Maitland and Town CEO Andrew Heiberger declined to comment. A spokesperson for BHS declined to comment.
The case will now proceed to trial on Oct. 14, according to a court clerk for Justice Barry Ostrager, who is presiding over the case.
Heiberger previously blasted Maitland over her move to BHS, claiming she repeatedly violated her employment agreement by stealing confidential information and conspiring to move to BHS in breach of her noncompete, bringing several agents with her. Town requested the injunction on Aug. 19.
Maitland argued the noncompete should be trashed, alleging what she termed “financial chicanery” at the company amounted to a breach of her contract.
