AT&T moves to dismiss lawsuit against recently completed East Hampton cell tower

Neighbors argued the tower's approvals were rushed

AT&T is asking a judge to dismiss a lawsuit filed by neighbors challenging the approvals for its recently completed cell tower in East Hampton, according to the East Hampton Press.

Approximately 10 residents who live near the tower filed the lawsuit, arguing that local authorities rushed approvals for the project.

In the motion to dismiss, AT&T’s attorneys argued that the neighbors never sought an injunction to stop construction of the tower. Andrew Campanelli, who is representing the neighbors in court, said that they did file for an injunction.

A pair of homeowners also sued the town in federal court, seeking $1.5 million in damages for estimated losses to property values because of the tower.

Locals have in the past opposed efforts to build new cell towers, citing health concerns and aesthetic reasons.
