Lennar sued over construction worker deaths

Miami-based homebuilder Lennar is facing a wrongful death lawsuit over an incident that killed two workers at a construction site in Conroe. 

A severe storm in May caused the collapse of a home that was under construction at the 3000 block of Pampaneria Drive, in a subdivision called Ladera Creek. Conroe is about 30 miles north of Houston.

The frame of the house caved in with people still inside. The incident killed two workers — 21-year-old Brayan Rubi Lopez Aguilar and 30-year-old Angel Gumaro Huerta Pedraza — and injured seven others. 

The Aguilar’s family and five of the injured workers sued Lennar in Harris County on July 10. They accused Lennar of negligence in keeping the site safe, saying that the firm “proceeded with conscious indifference to the rights, safety or welfare of others.” 

The plaintiffs in the new case alleged that Lennar failed to remedy dangerous conditions at site. At the time of the incident, there were warnings that the storm could cause wind gusts of up to 70 miles per hour. 

A representative for Lennar declined to comment. 

The case comes months after Omar Jimenez Medina, one of the workers injured in the incident, filed a $1 million lawsuit against Lennar. Medina’s lawsuit states that he developed a brain injury from the accident.  

The workers who survived said they sustained severe injuries from the incident and that the incident has taken away their earning potential. The plaintiffs are seeking a payout of $1 million each, as well as payments for medical expenses and court costs.
