Palm Beach County Circuit Court Judge David Crow ruled yesterday in
favor of the town of Palm Beach in a battle to get a referendum on the
Nov. 2 ballot protecting the Royal Poinciana Playhouse from demolition.
Judge Crow ruled that a proposed referendum that would have required
voter approval before certain landmarked buildings could be razed was
unconstitutional. “No matter how laudable these goals may be, that
decision is not by popular vote when that popular vote is in conflict
with Florida statutes,” Crow wrote in his order. Patrick Flynn, leader
of Preserve Palm Beach, the organization that is spearheading the bid,  has said he will appeal the decision. [Palm
