Harry Macklowe allegedly wants to lop off one-third of her condo
Linda Macklowe’s attorneys are asking a judge to issue a restraining order to halt construction — or in this case, demolition — of her apartment at 432 Park Avenue.
In a lawsuit filed Tuesday, the estranged wife of developer Harry Macklowe said her soon-to-be ex-husband filed plans to lop off one-third of Linda’s 2,663-square-foot apartment, co-opting that space for his own adjacent condominium unit. The plans would leave Linda with a 1,766-square-foot one-bedroom on 78th floor of the supertall tower, developed by Macklowe Properties and CIM Group.

Thursday’s motion cites the developer’s “outrageous actions,” and seeks the court’s intervention until a final ruling can be made.
“[Linda Macklowe] is being forced to choose between closing on an apartment which is substantially smaller than that which she has contracted to buy – at the full purchase price – and defaulting” on her purchase agreement, according to the filing. Linda Macklowe went into contract on the $14.4 million condo in 2013. Defaulting on the agreement would jeopardize her $2.16 million deposit, according to the filing.
Earlier this week, a spokesperson for the developer said the apartment was “a gift” and that Linda has categorically denied she will live there.
The divorce proceedings have included a forensic analysis of Macklowe’s extensive real estate portfolio and the couple’s valuable art collection — including several pieces by Andy Warhol — which is estimated to be worth up to $1 billion.
