Terms and Conditions for Subscriptions

This agreement discloses the Terms and Conditions for The Real Deal's subscriptions.

These Terms and Conditions ("Terms") govern your use of subscriptions provided by The Real Deal LLC ("Company"), including access to TRD Data and The Real Deal news subscription services.

1. Acceptance of Terms

By purchasing, accessing, downloading, or using any subscription service offered by the Company, you agree to be bound by these Terms. If you do not agree, you must not use the subscription services.

2. Subscription Terms

2.1 Automatic Renewal

All subscriptions automatically renew at the end of each billing cycle unless you cancel prior to the renewal date.

2.2 Cancellation Policy

You may cancel your subscription at any time before your next billing cycle to avoid future charges. Once a charge has been processed, the Company does not issue refunds.

3. Data Use and Content Restrictions

3.1 Limited License

The Company grants subscribers a limited, non-exclusive, non-transferable license to access and use the subscription content (including TRD Data and news content) solely for personal or internal business purposes, subject to these Terms.

3.2 Prohibited Actions

Subscribers may not:

  • Upload, publish, share, distribute, or make subscription content publicly available, whether online, through a private network, or otherwise.
  • Sell, sublicense, rent, lease, or otherwise commercialize any portion of the subscription content.
  • Modify, alter, adapt, reverse engineer, or create derivative works from any subscription content.

4. Ownership Rights

All rights, title, and interest in and to all subscription content, including all intellectual property rights, are and will remain the exclusive property of the Company. These Terms do not grant any rights to use the Company’s name, logo, or trademarks.

5. Penalties for Unauthorized Use

If you breach any provision of these Terms, the Company may seek all available legal remedies, including injunctive relief, damages, recovery of attorneys' fees, and termination of your subscription without notice. Unauthorized use may result in civil and criminal penalties.

6. Termination

The Company reserves the right to terminate or suspend your subscription at its sole discretion, with or without cause, and with or without notice.

7. Disclaimer of Warranty

All subscription services and content are provided "AS IS", without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

8. Limitation of Liability

To the fullest extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, goodwill, or other intangible losses arising from or related to your use of any subscription service.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles.
