Judge tosses 250 Bowery fraud charges against Douglas Elliman

Developer VE Equities still battles $13M negligence charge

A New York Supreme Court judge tossed fraud and false advertising charges against Douglas Elliman over the sale of allegedly damaged apartments at 250 Bowery.

Fraud charges against the developer, VE Equities, its co-defendants were also dismissed last week, but VE still faces charges of negligence.

The condominium board at 250 Bowery filed a lawsuit against VE, Douglas Elliman and Morris Adjmi Architects in February 2017 after a water pipe burst and damaged several apartments. The plaintiffs alleged that the leak was caused by shoddy construction and sought $13 million in damages.

“We are pleased that the court’s ruling was consistent with what we always maintained on behalf of our client and look forward to having the lone, surviving cause of action dismissed at the appropriate juncture,” attorney Terrence Oved said in a statement. Oved & Oved’s Darren Oved and Andrew Urgenson are representing the defendants. An attorney representing the condo board did not immediately respond to a request for comment.

Model Gigi Hadid briefly owned an apartment in the 24-unit Lower East Side building.
